4. SERVICE TERMS & CONDITIONS

Scope of Work

All services are limited strictly to the scope outlined in the written estimate, proposal, or invoice. Any additional work must be authorized in writing by the vessel owner or an authorized representative (including the captain or the management company).

Authorization

By requesting services, the client confirms they are the legal owner of the vessel or have full authority to approve work on behalf of the owner.


5. CONDITION OF VESSEL & PRE-EXISTING DAMAGE

Marine vessels naturally experience wear, oxidation, corrosion, fading, and material degradation. Marlin Yacht Management is not responsible for:

  • Pre-existing damage
  • Structural, mechanical, or cosmetic failures
  • Failure of aged, fragile, or improperly maintained materials

Clients are responsible for disclosing known issues prior to service. We reserve the right to document existing conditions before and after service.


6. RESULTS DISCLAIMER

Detailing and maintenance services aim to achieve the best possible result given the vessel’s condition, materials, and environment. Results may vary based on:

  • Age of surfaces
  • Prior maintenance history
  • Environmental exposure

No service guarantees a “like-new” condition unless explicitly stated in writing.


7. RISK, DAMAGE & LIMITATION OF LIABILITY

While all reasonable care is taken, yacht maintenance involves inherent risk. To the fullest extent permitted by Florida law:

  • Marlin Yacht Management shall not be liable for indirect, incidental, or consequential damages
  • Liability, if any, shall not exceed the amount paid for the specific service performed

Clients acknowledge and accept these risks when authorizing work.


8. WEATHER & MARINA CONDITIONS

Marine work is subject to weather, tides, marina access, and third-party interference. Delays or rescheduling due to environmental or marina conditions do not constitute breach of contract.


9. PAYMENT TERMS

Unless otherwise stated in writing:

  • Payment is due upon completion of services
  • Late payments may incur fees
  • Invoices unpaid beyond the agreed terms may result in the suspension of future services

10. CANCELLATIONS & RESCHEDULING

Cancellations or rescheduling should be communicated as early as possible. Repeated cancellations or no-shows may incur fees, especially for reserved labor or materials.


11. VIRUSES, MISUSE & SECURITY

You must not attempt to gain unauthorized access to this website or introduce malicious software. Any misuse may result in immediate termination of access and reporting to appropriate authorities.

We are not responsible for damage caused by viruses or cyber incidents arising from use of this site or linked third-party websites.


12. THIRD-PARTY LINKS
